WINTER SWEEPSTAKES RULES
Montana Ski Areas Association Give-Away ("Give-Away") is offered and open only to legal residents of the United States and District of Columbia who are 18 years or older. Employees, officers and directors of the Montana Department of Commerce (sponsor), MSAA, and their affiliates, prize suppliers, advertising and promotion agency, and the immediate family members (defined as current spouse as well as siblings, children and parents and their respective spouses; regardless of where they live) or members of the same households (whether related or not) of such employees/officers/directors are not eligible. Void where prohibited by law.
1. TO ENTER:
(A) ON-LINE ENTRY. Between December 20, 2008 at 12:00 a.m. Mountain Time ("MT") and 11:59 p.m. MT on February 15, 2009, go to www.skimt.com to register to win. On the Give-Away Page, complete and submit an on-line official entry form, with your name, address, daytime telephone number, and e-mail address. All on-line entries must be received by 11:59 p.m. MT on February 15, 2009. No other form of Internet/email entry will be accepted. Limit one entry of any kind per person or e-mail address. Any person who attempts to participate with multiple e-mail and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times will be disqualified. In case of dispute, on-line entry will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No responsibility is assumed by Sponsor for lost, late, damaged, incomplete, stolen, misdirected, illegible entries/e-mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions/failures; or for garbled, jumbled or corrupt transmissions; or for other technical error of any kind. Once submitted, entries become sole property of Sponsor and will not be returned.
2. WINNER SELECTION: Winners will be selected in a random drawing from among all eligible entries received. The drawing will be conducted by the Montana Department of Commerce the week of February 17, 2009. By participating, entrant agrees to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Winners will be notified by e-mail, phone or mail (at Sponsor's sole discretion) approximately 10 days after the drawing. No substitution or transfer of prize is permitted, but Sponsor reserves the right, at its sole discretion, to substitute advertised prize with another prize of equal value should advertised prize become unavailable for any reason. Limit one prize per family/address/household.
3. PRIZES/ODDS: Grand Prize (1) Blacktail Mountain - Two Day Ski and One Night Stay at Outlook Inn Bed and Breakfast for two adults. Dinner and drinks for two at Tamarack Brewing. Approximate Retail Value (ARV): $264. Grand Prize (2) Big Sky Resort - Two Day Ski and Three Night Slope Side Stay package for two people including a daily deluxe breakfast buffet. ARV: $1,300. Grand Prize (3) Bridger Bowl - Four Day Ski and Four Night Stay package for two adults with lodging at C’mon Inn in Bozeman. ARV: $520. Grand Prize (4) Red Lodge Mountain - Two Day Ski and Three Night Stay for four people. ARV: $634. Grand Prize (5) Whitefish Mountain Resort – Three Day Ski and Three Night Stay package for two adults. ARV: $828. Grand Prize (6) Showdown Montana Ski Area – Two Day Ski and One Night Stay Package for two adults with Lodging at the All Season Inn and Suites. ARV: $210. Grand Prize (7) Discover Ski Area - One night stay at Fairmont Hot Springs and one day skiing at Discovery Ski Area for two people. ARV: $200.
FOR ALL GRAND PRIZES: Ski and Stay Packages are subject to availability and other restrictions. Winner and guest must be able to travel during the remainder of the 2009 winter season. If winner is unavailable at such time, prize will be forfeited in its entirety without compensation of any kind. If winner is not accompanied by a guest on trip, prize elements will only be awarded in amounts appropriate for actual number of travelers; and, in such event, winner will NOT receive any compensation relative thereto. Winner and guest must travel together on same itinerary as determined by Sponsor in its sole discretion. If guest is a minor, they must travel with his/her parent/legal guardian on trip.
4. GENERAL CONDITIONS: All taxes on prizes and all expenses not specified herein associated with claiming/use/acceptance prize is the sole responsibility of the winner. Grand Prize winners must sign and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within 10 days of the date on documents. Guests of Grand Prize winners (if minor, his/her parent or legal guardian) must sign and return a liability release and where lawful a publicity release prior to the issuance of travel documents. Grand Prize winners and guests may also be required to sign additional documentation from the Montana Department of Commerce and/or the host mountain and/or to provide the Montana Department of Commerce and/or the host mountain with written authorization from a licensed physician as a pre-condition to taking trip. In the event of noncompliance with these requirements (as applicable), or if prize notification is returned as undeliverable, such prize will be forfeited and an alternate winner selected from all remaining eligible entries received for drawing. By participating, entrant releases and agrees to hold harmless The Montana Department of Commerce and their respective parent, affiliates, prize suppliers, advertising and promotion agency and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, losses or damages of any kind to persons and/or property arising from acceptance, possession, use/misuse of any prize or participation in this Sweepstakes. By accepting prize, where legal, winner grants to Sponsor the right to use the winner's name, picture, voice, likeness and biographical information for advertising/promotional/trade purposes, and any and all rights to such use, without additional consideration.
5. LIMITATIONS OF LIABILITY: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Give-Aways. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW. Any use of robotic, automatic, macro, programmed or like on-line entry methods will void all such entries by such methods, and result in disqualification of any entrant using such methods. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in the Give-Aways or downloading materials from or use of the web site. If, for any reason, the on-line component of the Give-Aways is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the on-line component of the Give-Aways, Sponsor reserves the right at its sole discretion to cancel, modify or suspend the on-line component of the Give-Aways and select the winners in a drawing from all eligible event and mail-in entries received and all eligible on-line entries received prior to and/or after (as appropriate) the action taken by Sponsor. In such event, notice will be posted at www.skimt.com.
6. WINNERS LIST: For names of winners, mail a self-addressed, stamped envelope to Travel Montana, Attn: Montana Ski Areas Association Give-Aways, 301 S. Park Ave., Helena, MT 59620 by February 28, 2009.
